1. TERMS OF USE AND SALES

Your use of the BIK’O Products Inc. website bikoproducts.com (the “Site”) indicates your acceptance of these Terms of Use and Sale (the “Terms of Use and Sale”). The Site is the exclusive property of Produits BIK’O inc.

In addition to the Terms of Use and Sale, the Privacy Policy applies to the use of the Site.

The Terms of Use and Sale are subject to change without notice; any changes will be effective upon posting on the Site. It is your responsibility to check for updates to the Terms of Use and Sale. Your use of the Site after the Terms of Use and Sale have been updated will be deemed acceptance of the amended Terms of Use and Sale.

2. RIGHT TO REFUSE OR CANCEL YOUR ORDER

Produits BIK’O may, in its sole and absolute discretion, refuse or cancel any order and limit the quantities ordered. Produits BIK’O may also request additional information before processing your order. At any time after receiving your order, Produits BIK’O reserves the right to accept, decline or cancel your order for any reason. Produits BIK’O may refuse or cancel an order for any of the following reasons

  • the product is not available or is out of stock
  • the billing information is incorrect;
  • the order is flagged by our security systems as unusual or potentially fraudulent we have reason to believe that you are a reseller, merchant, or distributor;
  • we have reason to believe that you are a business and are placing a corporate order;
  • in the event of an editorial error, pricing error or any other error related to the information available on the website.

However, Produits BIK’O will refund any order cancelled after billing.

3. DELIVERY POLICY

Delivery time
Orders placed on the site bikoproducts.com are normally processed within 3 to 5 business days. However, it is necessary to provide a delivery time more important for remote areas or outside Quebec. Produits BIK’O can not be held responsible for excess delivery times caused by carriers (Purolator, Fedex, Campar etc..).

Remote areas of Canada
Customers from remote areas of Canada are welcome to visit BIK’O Products. Delivery charges are calculated according to the weight of the order and your location. Please note that we reserve the right to cancel your order if a free shipping promotion has been applied that is not valid for you. The cost calculator will show you the associated price when you confirm your order. Delivery time depends on your location and can normally take up to 8 business days.

Maximum weight
The maximum weight of any package delivered by BIK’O Products Inc. is 20 kg.

Payment
Orders placed on the Site must be paid by credit card VISA, MASTERCARD or AMERICAN EXPRESS. The price is payable in full and in one payment at the time of the order.

Price
The price payable for each product you order is the one appearing on the Site for each product offered, including applicable taxes. Delivery charges must be added to this price. All prices are in Canadian dollars. Produits BIK’O reserves the right to modify the prices of the products offered on the Site at any time, without notice. The prices of products on the Site may differ from the prices offered for the same products in independent boutiques or other points of sale.

International Packages
For all deliveries outside of Canada, any customs fees and local taxes are the responsibility of the recipient. Please note that the exchange rates applied are those in effect on the day of the order. Produits BIK’O inc. and bikoproducts.com is not able to provide estimates of customs duties and the customer must check by himself with his local customs office.

Lost package
If your package has been lost in transit, please notify us by email at bikoproducts@gmail.com or by phone at 514-794-5751, within 10 business days of the order date. When a package is lost, our team quickly follows up with the carrier by opening a service ticket. Our carriers generally allow 10 business days from the date of the claim to respond to find out if the package has been found or if it is really lost. After the tenth day, if the package is still lost, we will resend the products free of charge or refund the order, at your option. You will be kept informed throughout the process by our customer service department.

Items damaged in transit
Produits BIK’O makes sure to ship the items in a condition consistent with the product offered on bikoproducts.com and makes sure to pack the items properly to avoid breakage during transport. If you receive a damaged item, please email us at bikoproducts@gmail.com or call 514-794-5751 within 5 business days of receiving the package. In the case of a damaged product, Produits BIK’O will reimburse the value of the damaged item and the taxes (if applicable). In the case of a return of the products, a new package will be shipped within 3 to 5 business days.

Cancellation or modification of an order
To cancel or modify a current order, please send us an email at bikoproducts@gmail.com or call 514-794-5751. If the package is not shipped, the order amount can be refunded or modified. If your order has already been shipped, it will not be possible to obtain a refund for the products shipped.

4. REFUNDS

No refunds will be given on products once the order is placed unless the products sold are defective or do not conform to your order. All products that are defective or do not conform to your order must be returned within twenty days of receipt of the order and be accompanied by the invoice. Return shipping costs are the responsibility of the customer. The products must be intact and in their original packaging.

For any defective product or product that does not conform to your order, Produits BIK’O will reimburse the purchase price of the product and the portion of the shipping costs related to the refunded product (including taxes) upon receipt of the products. The refund will be made to the credit card used to place the order. Defective products or products that do not conform to the order must be returned to : Produits BIK’O, 31 rue de Lyon, Repentigny (Québec), J5Z 4Z3.

5. ONLINE SALES ECLUSIVE TO CONSUMERS

Produits BIK’O sells products online to consumers or professionals only. Therefore, we reserve the right to refuse or cancel your order if we believe the products are intended for resale.

6. PRODUCTS PHOTOS AND/OR ILLUSTRATIONS

Some products may be associated with an image or photograph. Product images or photographs are provided for reference or illustration purposes only and may differ from the actual product. Due to differences in monitors, product colors may also appear different from those shown on this website. Product assortments and selections, packaging may vary without notice. The images on bikoproducts.com are copyrighted and may not be used without permission from BIK’O Products.

7. MAJOR FORCE

BIK’O Products shall not be liable for the failure to perform, in whole or in part, any of its obligations to you, or for any damages or losses you may suffer, if the failure to perform, damages or losses result from an event of force majeure or a circumstance beyond its control.

8. APPLICABLE LAWS

These terms and conditions of sale shall be governed by and construed in accordance with the laws of the Province of Quebec and the laws of Canada applicable therein, and any disputes shall be submitted to a court of competent jurisdiction in the judicial district of Quebec, Province of Quebec. If any provision of these terms and conditions of sale shall be unlawful, void or unenforceable, then that provision shall be deemed unwritten without limiting the remaining provisions.

The Terms of Sale and any other legal notices or statements appearing on the Site constitute the entire agreement between you and Produits BIK’O with respect to the use of the Site, including its content.

9. CONTENT OF THE SITE

The BIK’O Products name and logo are trademarks of BIK’O Products Inc. You may not copy, imitate, modify, reproduce, publish, display, distribute or otherwise use them, in whole or in part, without the prior written permission of Produits BIK’O. In addition, all scripts, page headers, custom graphics and button icons on the Site are considered to be trademarks of BIK’O Products and the exclusive property of BIK’O Products.

While Produits BIK’O strives to ensure maximum availability of the Site, there may be times when the Site is unavailable, including, but not limited to, scheduled maintenance or upgrades, emergency repairs, or failure of equipment or telecommunications links. Produits BIK’O further reserves the right to remove any portion of the Site for any reason without notice.

10. DISCLAIMER/LIMITATION OF LIABILITY

The Site, including the content and services it offers, is made available to you without warranty of any kind, either express or implied. Produits BIK’O does not warrant that the functions offered on its Site will be uninterrupted, error-free, virus-free or otherwise inconvenient. Produits BIK’O cannot, under any circumstances, be held responsible for direct or indirect damages resulting from the use of the Site, its content or the services offered or from the impossibility to use them, or that would be related to them, even if Produits BIK’O has been advised of the possibility of such damages.
